The Supreme Court of India is the final court of appeal and the guardian of the Constitution. Unlike a trial court, it does not ordinarily re-examine witnesses or weigh fresh evidence. A Special Leave Petition under Article 136 asks the Court to exercise a discretionary jurisdiction, and the Bench will look for a substantial question of law, a manifest miscarriage of justice, or a conflict between High Courts before it agrees to hear the matter at all. This means that the way a case is framed — the questions of law identified, the grounds drafted, the synopsis and list of dates prepared — often decides the outcome before a single word is argued.

A Supreme Court advocate therefore does a very different job from a lawyer at the district court. The advocate must distil years of litigation into a few pages that persuade the Court there is something worth its time; must know the Supreme Court Rules, 2013 and the Registry's scrutiny practice so that the petition is not returned with defects; and must be able to argue crisply when the matter is called out, sometimes for only a few minutes. Litigants who reach the Supreme Court with a weak or badly framed petition rarely get a second chance, because dismissal of an SLP in limine is the end of the road.

Begin with the subject matter. A bail or criminal appeal, a service dispute for a government employee, a constitutional writ, a land acquisition or tenancy fight, a commercial arbitration and a matrimonial or custody matter each draw on different bodies of case law. Look for an advocate whose practice areas match your problem and read the biography on their profile to understand how they approach client representation. Years of experience matter, but so does familiarity with the particular statute — the Bharatiya Nyaya Sanhita and Bharatiya Nagarik Suraksha Sanhita for criminal matters, the Arbitration and Conciliation Act for commercial disputes, or the relevant service rules for employment cases.

Check the practical details as well. Every advocate in India must be enrolled with a State Bar Council under the Advocates Act, 1961, and the Bar Council enrolment number is a basic verification you are entitled to ask for. Only an Advocate-on-Record can file in the Supreme Court, so ask whether the advocate is an AoR or works with one. Consider the languages the advocate speaks, since you will need to explain facts and understand advice in a language you are comfortable with, and consider where the advocate is based — a lawyer in your own city can meet you and gather documents, while coordinating with counsel in New Delhi for hearings.

Finally, insist on candour. A good Supreme Court lawyer will tell you when a case is weak, when limitation has expired, or when the better route is a review or a fresh proceeding rather than an SLP. Most matters begin with the filing of a Special Leave Petition within ninety days of the High Court's judgment, together with a certified copy of that judgment, the pleadings from the courts below, an affidavit and the prescribed court fee. The Registry scrutinises the petition and lists defects, which must be cured before the matter is numbered and listed before a Bench. At the admission hearing the Court may dismiss the petition, issue notice to the opposite party, grant interim relief such as a stay or protection from arrest, or grant leave and convert the petition into a regular appeal.

If notice is issued, the respondent files a counter-affidavit and the petitioner may file a rejoinder. The matter then waits for final hearing, which can take months or years depending on the Bench and the category of case. Hearings are conducted in English, though the Court now permits hybrid appearance through video-conferencing in many matters. Throughout the process your advocate will keep you informed about listing dates, the Bench composition and the likely timeline, and will ask you for documents and instructions as the matter progresses. Costs include drafting and filing charges, per-appearance fees and the fees of senior counsel if one is briefed; a transparent advocate will explain these before you commit.

Supreme Court practice has a distinctive structure. The Advocate-on-Record is the lawyer who is formally responsible for the case — they file the petition, receive notices from the Registry, and are accountable to the Court for everything on the record. A Senior Advocate, designated under Section 16 of the Advocates Act, 1961 by the Supreme Court or a High Court, is a lawyer of recognised standing who argues matters but, by the rules of the profession, does not file pleadings or deal directly with clients. Senior counsel are briefed by the AoR and appear alongside them.

For most litigants the practical question is whether engaging senior counsel is worth the cost. In matters involving a complex question of law, high stakes or a strongly contested admission hearing, the experience and credibility of senior counsel can make a real difference.
