What is a Child Custody Transfer Petition?
A Child Custody Transfer Petition before the Supreme Court seeks to transfer guardianship or custody proceedings from one court to another — either from one state to another in India, or to invoke the Supreme Court's jurisdiction in international custody/abduction disputes. It is an urgent matter given the child's welfare and the risk of the child being taken out of jurisdiction.
The transfer of a matrimonial case that includes custody proceedings follows Section 25 CPC (applicable for civil custody proceedings). However, where a child has been wrongfully removed from one parent's custody and taken to another state or country, the Supreme Court exercises its habeas corpus jurisdiction under Article 32 or Article 142 to immediately secure the child and address the custody question on the basis of the child's best interests.
In international child abduction cases, India is not yet a signatory to the Hague Convention on Civil Aspects of International Child Abduction — however, the Supreme Court has developed a substantial jurisprudence on the principle of 'closest concern' and the child's welfare as the paramount consideration. The Court has ordered return of children to foreign countries in appropriate cases based on international comity and the child's best interests.
When Should You Approach the Supreme Court for Child Custody?
- One parent has taken the child from one state to another without consent, and the custody case is pending in the original state — risking conflicting orders
- Multiple custody proceedings are pending in different courts (matrimonial court, guardianship court, High Court) and you need consolidation
- A parent has taken the child outside India without the other parent's consent and you need urgent Supreme Court intervention
- A foreign court has given a custody order and the parent in India is not complying with it — you need Indian court enforcement
- There is an imminent threat that the child will be removed from India or hidden — requiring urgent habeas corpus / production order
