What this case type involves

Pension is not a bounty but a right earned by service; withholding or reducing it requires authority of rules and, ordinarily, a finding of grave misconduct in proceedings that were pending at retirement or instituted within the permitted time. Delayed payment attracts interest. Gratuity for employees covered by the Payment of Gratuity Act 1972 is payable within 30 days, failing which interest is due.

Filing procedure, step by step

  1. 1Submit pension papers before retirement; follow up in writing with the Head of Office and Pay and Accounts Office.
  2. 2For gratuity disputes under the 1972 Act, apply to the Controlling Authority (Assistant Labour Commissioner) under Section 7(4).
  3. 3Approach the Tribunal or High Court if pension is withheld without proceedings or unreasonably delayed.

Limitation periods

  • Gratuity claim before the Controlling Authority: 90 days, extendable on sufficient cause (Rule 10, Payment of Gratuity (Central) Rules 1972).
  • Tribunal application: one year from rejection of representation; recurring pension claims are treated leniently on delay.

Limitation is computed under the Limitation Act 1963 and the specific statute; the time taken to obtain certified copies is generally excluded. Verify the applicable period with counsel before filing.
